Welcome to SalonSync. These Terms of Use ("Terms") govern your access to and use of the SalonSync platform, website, and mobile applications ("Service"). By creating an account or using our Service, you agree to be bound by these Terms.
1. Service Description
1.1 What We Offer
SalonSync is a booking platform connecting clients with salons, barbers, wellness professionals, and other service providers across Ireland. Our Service includes:
- Online appointment booking and management
- Business discovery by category and location
- Secure payment processing for deposits and full payments
- Automated reminders and notifications
- AI-powered business tools for salon owners (inventory management, insights, voice commands)
- Staff scheduling and client management for businesses
1.2 Platform Role
SalonSync acts as a technology platform. We do not provide salon, beauty, or wellness services ourselves. Service providers are independent businesses responsible for the services they offer. Appointments are contracts between you and the service provider.
2. Account Registration
2.1 Eligibility
You must be at least 16 years old to create an account. By registering, you confirm that:
- You meet the age requirement
- All information provided is accurate and complete
- You will keep your account information up to date
- You are legally able to enter into contracts in Ireland
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of unauthorized access at support@salonsync.ie
2.3 Business Accounts
Service providers registering business accounts must:
- Have legal authority to represent the business
- Provide accurate business registration and tax information
- Comply with all applicable Irish licensing and regulatory requirements
- Maintain appropriate insurance for their services
3. Bookings and Cancellations
3.1 Making Bookings
When you book an appointment:
- You agree to attend the appointment at the scheduled time
- You may be required to pay a deposit or full payment upfront
- You'll receive confirmation via email and/or SMS
- Special requests are not guaranteed unless confirmed by the provider
3.2 Cancellation Policy
Client Cancellations:
- Cancellation policies are set by individual service providers
- Late cancellations or no-shows may result in forfeiture of deposits
- Refund eligibility depends on the provider's policy and timing
- Repeated no-shows may result in account restrictions
Provider Cancellations:
- If a provider cancels, you'll receive a full refund of any prepayment
- We'll assist in rebooking where possible but cannot guarantee availability
3.3 Changes to Bookings
Appointment changes (time, service, staff) are subject to provider availability and may require approval. Contact the provider directly or through the app.
4. Payments and Fees
4.1 Client Payments
- Payment Processing: All payments processed securely through Stripe
- Accepted Methods: Credit/debit cards, Apple Pay, Google Pay
- Pricing: Prices set by service providers; SalonSync does not control pricing
- Currency: All transactions in Euro (€)
4.2 Business Fees
Service providers pay subscription fees to use SalonSync:
- Monthly or annual subscription plans
- Fees clearly disclosed before registration
- Payment terms specified in provider agreement
- No hidden fees or commission on client bookings
4.3 Refunds
- Subscription refunds follow our standard cancellation policy
- Client booking refunds determined by provider cancellation policy
- Refunds processed within 5-10 business days
- Disputes may be escalated to support@salonsync.ie
5. AI Assistant and Automated Features
5.1 AI Usage by Businesses
Salon owners may use AI-powered features for:
- Inventory management and stock level checks
- Business insights and analytics
- Voice-activated queries and commands
- Automated appointment confirmations
5.2 Accuracy Disclaimer
AI responses are provided for informational purposes only. While we strive for accuracy:
- AI may occasionally provide incorrect or incomplete information
- Business owners should verify critical information independently
- SalonSync is not liable for decisions made based on AI recommendations
- AI does not replace professional business judgment
5.3 Data Processing
AI features process data as described in our Privacy Policy. Business owners consent to AI processing when enabling these features.
6. User Responsibilities
6.1 Prohibited Conduct
You may not:
- Violate any laws or regulations
- Impersonate others or provide false information
- Harass, abuse, or threaten other users or staff
- Use the Service for fraudulent purposes
- Attempt to gain unauthorized access to our systems
- Scrape, data mine, or use automated tools without permission
- Post inappropriate, offensive, or harmful content
- Interfere with the Service or other users' access
6.2 Content Standards
Any content you post (reviews, messages, photos) must:
- Be accurate and truthful
- Not infringe intellectual property rights
- Comply with Irish defamation and content laws
- Not contain spam, advertising, or promotional material
6.3 Compliance
Service providers must comply with all applicable Irish regulations, including:
- Business licensing and permits
- Health and safety standards
- Tax and VAT obligations
- Data protection (GDPR) for client information
- Consumer protection laws
7. Intellectual Property
7.1 Our Rights
SalonSync and its logos, design, features, and content are protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute our software or content
- Reverse engineer or decompile the platform
- Use our trademarks without written permission
- Create derivative works based on our Service
7.2 Your Content
You retain ownership of content you post (photos, reviews, business information). By posting content, you grant SalonSync a worldwide, non-exclusive license to:
- Display and distribute your content on our platform
- Use business photos and information for marketing (with permission)
- Moderate and remove content that violates these Terms
8. Disclaimers and Limitation of Liability
8.1 Service "As Is"
SalonSync is provided "as is" and "as available." We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Results from the Service will be accurate or reliable
- Defects will be corrected immediately
- Service providers will meet your expectations
8.2 Provider Responsibility
Service providers are independent contractors. SalonSync is not responsible for:
- Quality, safety, or legality of services provided
- Actions or omissions of service providers or their staff
- Disputes between clients and service providers
- Personal injury, property damage, or losses incurred during appointments
8.3 Limitation of Liability
To the maximum extent permitted by Irish law:
- SalonSync's total liability for any claim is limited to €100 or the fees you paid in the past 12 months, whichever is greater
- We are not liable for indirect, incidental, consequential, or punitive damages
- This includes loss of profits, data, goodwill, or business opportunities
- Nothing in these Terms excludes liability that cannot be excluded under Irish law (e.g., death or personal injury caused by negligence)
9. Indemnification
You agree to indemnify and hold harmless SalonSync, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of others
- Services provided by your business (for service providers)
10. Termination
10.1 By You
You may close your account at any time by contacting support@salonsync.ie. Active bookings must be cancelled separately. Subscription fees are non-refundable for the current billing period.
10.2 By SalonSync
We may suspend or terminate your account if:
- You violate these Terms or our policies
- You engage in fraudulent or illegal activity
- Your account is inactive for 24+ months
- Required by law or legal process
- We cease operations (with 30 days' notice)
10.3 Effect of Termination
Upon termination:
- Your access to the Service ends immediately
- Outstanding payments remain due
- Certain provisions (liability, indemnification) survive termination
- We may retain data as required for legal/accounting purposes (see Privacy Policy)
11. Changes to Terms
We may update these Terms from time to time to reflect:
- Changes in law or regulation
- New features or services
- Operational improvements
We'll notify you of material changes via:
- Email to your registered address
- In-app notification
- Prominent notice on our website
Continued use after changes indicates acceptance. If you don't agree, you must stop using the Service and close your account.
12. Dispute Resolution
12.1 Informal Resolution
Before pursuing formal action, please contact support@salonsync.ie to resolve disputes informally. We'll work in good faith to reach a mutually acceptable solution.
12.2 Governing Law
These Terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.
12.3 Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under Irish or EU law. For consumer complaints, you may contact the Competition and Consumer Protection Commission (CCPC) at www.ccpc.ie.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SalonSync regarding the Service.
13.2 Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
13.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
13.4 Assignment
You may not transfer your rights under these Terms. We may assign our rights to affiliates or successors.
13.5 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, technical failures).
